  • Wrongful Termination and Employment Discrimination:

    The Garber Law Firm has extensive experience defending employers in cases involving claims of employment discrimination and wrongful termination. From the initiation of a charge with a governmental agency such as the Equal Employment Opportunity Commission or the Department of Fair Employment and Housing through the investigative stage and a trial, we vigorously defend our clients. We handle claims arising under Title VII of the Civil Rights Act of 1964, the Fair Employment and Housing Act, the Americans with Disabilities Act, the Family Medical and Leave Act, California Labor Code 132a and numerous other statutes and federal statutes governing the workplace.

    Additionally, we regularly defend employers in cases alleging sexual harassment, wrongful termination, breach of contract, breach of the duty of good faith and fair dealing, violations of public policy, infliction of emotional distress, negligent hiring and numerous other actions involving an employers' employees and former employees.

    We also provide Employers with advice on how to prevent claims from arising and to solve problems before they rise to the level of litigation. We draft Employment policies and procedures for our clients as well as provide training to managers on how to handle many situations likely to occur in the workplace.

    The Garber Law Firm represents management in traditional Labor Law matters arising under the National Labor Relations Act and the Railway Labor Act. We appear before the National Labor Relations Board representing our clients in Unfair Labor Practices cases as well as Union Organizing drives, decertification petitions, deauthorization petitions and unit clarification matters. Additionally, we regularly negotiate collective bargaining agreements on behalf of our unionized Employers, as well as represent them in arbitrations arising under those Agreements. For our non-union clients we provide advice on how to remain non-union and assist in union avoidance.

    The Garber Law Firm has extensive experience in representing employers in all aspects of Wage and Hour Law. California has unique wage and hour laws and regulations and we regularly advise our clients on complying with those laws. We regularly defend employers in proceedings before the California Labor Commissioner and U. S. Department of Labor as well as state and federal courts in matters involving issues such as overtime issues involving questions of exempt/non-exempt status of employees, failure to pay wages due and owing, and vacation pay disputes to name a few. Additionally, we are involved in issues concerning whether or not people working for you should be classified as employees or independent contractors. We also advise our clients when they are faced with an audit from the U.S. Department of Labor or the California Labor Commissioner.
